Instructions for completing the Release of Liability, Waiver of Claims and Assumption of Risks form

Please thoroughly read, complete, and sign this Release of Liability, Waiver of Claims, and Assumption of Risks form.

If you are under the age of 19, this must be completed by your parent/guardian.

Please type your initials in each box, where required, after you have reviewed a section or paragraph.

If you are a parent/guardian signing for a minor, please put the minor’s name on the Member’s Name Line, and your name where indicated for parent/guardian.

Please date the form.

Upon completion of the waiver, you will receive an email to confirm you signed the waiver (required due to the use of a typed initial and signature). Please click on the link in the email to confirm.

Waiver Agreement

  • British Columbia Blind Sports and Recreation Association (BC Blind Sports) MEMBER PHYSICAL ACTIVITY, RECREATION, SPORT AND ASSOCIATED ACTIVITIES CONSENT, WAIVER AND PHOTO/VIDEO WAIVER MEMBERS MUST SIGN THIS DOCUMENT IN ORDER TO PARTICIPATE IN BRITISH COLUMBIA BLIND SPORTS AND RECREATION ASSOCIATION SANCTIONED ACTIVITIES. PLEASE READ IT CAREFULLY OR HAVE IT READ TO YOU SO THAT YOU UNDERSTAND THE CONTENTS BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION PLEASE READ CAREFULLY! For all Members: By signing this agreement you will incur certain legal obligations and waive legal rights that you, both as an individual and as a parent or legal guardian of any minor or minors (i.e. those under 19, the age of majority in British Columbia) who you are signing on behalf of (the “Child(ren)”), may have, including the right to sue or claim compensation following an accident. By signing on behalf of the Child(ren), you also waive certain legal rights that the Child(ren) may have. If you are not signing on behalf of a Child, you can ignore the references to “the Child(ren)” contained herein. In consideration of British Columbia Blind Sports and Recreation Association, a British Columbia Society, (“BC Blind Sports") permitting the individual named below ("I", "me" or “my Child(ren)”) to participate in sport, recreational, and physical activities (whether in person or virtually), administrative activities associated with or organized by BC Blind Sports, and if necessary, to receive transportation from a BC Blind Sports staff member or volunteer in a vehicle, the following activities are including but not limited to: • track and field, curling, dragon boat, goalball, golf, hockey, judo, karate, lawn bowls, powerlifting, showdown, skiing, swimming, tandem cycling, triathlon, wrestling; • hiking, nature walks, stair climbing, scavenger hunts, exploring outdoors and similar activities; • fundraising, volunteering, serving food or beverages, promoting BC Blind Sports, attending social functions and similar activities; • receiving transportation in the private vehicle of a BC Blind Sports staff member or volunteer to and from a location where an activity is scheduled to occur; (the “Activities”); and for other good and valuable consideration, I agree to all the terms and conditions set forth in this agreement (this "Agreement"). ASSUMPTION OF RISKS I am aware and understand that participation in the Activities involves certain inherent risks, dangers and hazards which may result in serious personal injury or death or other loss or damage to property. I am aware that the risks, danger and hazards include but are not limited to: • obstacles • uneven or slippery terrain; • unstable ground; • changing environmental and weather conditions; • faulty, inappropriate or inadequate equipment or gear; • collision with fences, trees, rocks, and other objects; • collision with vehicles, equipment or structures; • collision with other persons and/or animals; • use of medication, including an EPI pen; • the failure to act safely or within one's own ability or to stay within designated areas; • my own negligence, the Child(ren)’ negligence, the negligence of other persons participating in the Activities, and negligence on the part of BC Blind Sports; • encounters with wildlife; • exposure to communicable diseases; • exposure to the elements; and • vehicle accident which could result in serious injury, including whiplash, fractures, head trauma, spinal cord injuries, and internal organ damage.
  • I am aware that accidents can occur with or without any fault on either the part of the participants, or BC Blind Sports, its employees, agents or volunteers, or the facility where the activity is taking place. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING OR VOLUNTARILY ALLOWING MY CHILD(REN) TO PARTICIPATE IN THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ANY AND ALL OF THE RISKS, DANGERS AND HAZARDS INVOLVED AND THE POSSIBILITY OF INJURY, DEATH OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF BC BLIND SPORTS OR OTHERWISE. I further acknowledge and agree that the activities of BC Blind Sports that I and/or my Child(ren) choose to participate in, are suitable for me and/or my Child(ren). I agree to consult with BC Blind Sports staff should I require additional information regarding any BC Blind Sports activities prior to participating in them.
  • I WAIVE ANY AND ALL CLAIMS I MAY HAVE AGAINST, AND RELEASE FROM ALL LIABILITY AND AGREE NOT TO SUE BC BLIND SPORTS, ITS AFFILIATES AND ITS OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS AND REPRESENTATIVES (COLLECTIVELY THE “RELEASEES”) FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS SUSTAINED AS A RESULT OF MY OR MY CHILD(REN)’S PARTICIPATION IN THE ACTIVITIES, ARISING OUT OF ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE.
  • I SHALL HOLD HARMLESS AND INDEMNIFY BC BLIND SPORTS AND THE RELEASEES FROM ANY AND ALL CLAIMS, JUDGMENTS, AWARDS, DEMANDS, DAMAGES, LOSSES, LIABILITY, AND EXPENSES (INCLUDING LEGAL FEES) ASSOCIATED WITH, RESULTING FROM, OR IN ANY WAY RELATED TO ANY DAMAGE, OR LOSS, EXPENSE, OR INJURY TO ANY THIRD PARTY AND/OR TO THE CHILD(REN) RESULTING FROM MY AND/OR THE CHILD(REN)’ PARTICIPATION IN THE ACTIVITIES EXCEPT THOSE RESULTING FROM THE GROSS NEGLIGENCE OR WILFUL MISCONDUCT OF BC BLIND SPORTS.
  • By signing below, I hereby grant BC Blind Sports, on behalf of myself and on behalf of my Child(ren), the irrevocable right and permission to photograph and/or record me or my Children in connection with the Activities and to use the photograph and/or recording for all purposes, including advertising and promotional purposes, in any manner, in perpetuity throughout the world, without restriction as to alteration. I waive any right to inspect or approve the use of the photograph and/or recording, and acknowledge and agree that the rights granted in this release are without compensation of any kind.
  • This Agreement constitutes the entire agreement of BC Blind Sports and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall enure to the benefit of me, my heirs, next-of-kin, executors and administrators, and BC Blind Sports and its successors and assigns. This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any claim or cause of action arising under this Agreement may be brought only in the courts of the Province of British Columbia, and I hereby consent to the exclusive jurisdiction of such courts.
